These terms govern your use of the 1UP Esports website and the services we offer through it. By using the site, you agree to them. Please read carefully.

1. Acceptance of these terms

By accessing or using the 1UP Esports website you confirm that you’ve read these terms and agree to be bound by them. If you don’t agree, don’t use the site. We may update these terms from time to time. See Section 11.

2. Eligibility

You must be at least 13 years old to use this site. If you’re under 18, you may only use it with the involvement of a parent or legal guardian who agrees to these terms on your behalf. The site is not intended for use by anyone barred from doing so under applicable law.

3. Permitted use

You agree to use the site only for lawful purposes. Specifically you will not:

  • Attempt to break, probe, or interfere with the site’s normal operation.
  • Use automated tools (scrapers, crawlers, bots) to harvest content without our prior written consent.
  • Impersonate any person or misrepresent your affiliation with us.
  • Upload or transmit anything that’s illegal, hateful, abusive, infringing, or otherwise harmful.
  • Use the site to advertise or solicit business without our permission.

4. Accounts

Some areas of the site (the shop, gated content, community features) may require an account. You’re responsible for keeping your login credentials confidential and for everything that happens under your account. Notify us immediately if you suspect unauthorised use.

5. Intellectual property

All site content (logos, copy, graphics, photography, video, design, code) is owned by 1UP Esports or our licensors and is protected by US and international copyright, trademark, and other laws. You may view and share the content for personal, non-commercial use. You may not copy, modify, distribute, sell, or use it commercially without written permission.

6. User-submitted content

If you send us a message, post to a community feature, or otherwise submit content through the site, you keep ownership of that content. By submitting it you grant us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce, and adapt it for the purposes of running the site and promoting the team. You represent that you have the right to grant that licence and that the content doesn’t infringe anyone else’s rights.

7. Third-party links and services

The site links to platforms we don’t control (Discord, Twitch, YouTube, TikTok, X, payment processors, etc). We’re not responsible for the content, policies, or practices of those third parties. Their terms and privacy policies govern your use of their services.

8. Disclaimers

The site is provided as is and as available, without warranties of any kind, express or implied. We don’t warrant that the site will be uninterrupted, error-free, secure, or free of viruses, and we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, 1UP Esports and its owners, staff, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the site. Our aggregate liability for any direct claim relating to the site will not exceed one hundred US dollars (US$100).

10. Indemnification

You agree to indemnify and hold 1UP Esports harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these terms, your misuse of the site, or your violation of any third party’s rights.

11. Changes to these terms

We may update these terms from time to time. When we do, we will change the “last updated” date at the top of this page. Continued use of the site after the change means you accept the revised terms.

12. Termination

We may suspend or terminate your access to the site at any time if we believe you’ve breached these terms or for any other reason we consider reasonable. You can stop using the site at any time. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will remain in effect.

13. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute relating to the site will be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
